Please find below a selection of recent legislation changes relating to COVID-19 and communications for workplaces from key safety and environmental regulators in Australia and New Zealand.

LEGISLATION CHANGES

Migration Amendment (Subclass 189 Visas) Regulations 2021

  • Amends the Migration Regulations 1994 to make it easier for applicants for a Subclass 189 (Skilled - Independent) visa in the New Zealand stream to satisfy the annual income requirement.


Public Health (COVID-19 Areas of Concern) Notice 2021 (No 73)

  • Identifies the State of Victoria as an affected area subject to a stay at home requirement and certain locations in Victoria as places of concern.

Public Health Amendment (COVID-19 Spitting and Coughing) Regulation (No 2) 2021

  • Allows for the issue of penalty notices for an offence against the Public Health Act 2010, Section 10, involving a contravention of a Ministerial direction under the Public Health (COVID-19 Spitting and Coughing) Order (No 2) 2021 about intentionally spitting or coughing on a public official or other worker in a way that is likely to cause fear about the spread of COVID-19.

Public Health (COVID-19 Interstate Travellers) Order (No 2) 2021

  • Identifies the State of Victoria as an affected area and an area of concern, and identified certain locations in Victoria as places of high concern.

Public Health (COVID-19 Spitting and Coughing) Order (No 2) 2021

  • Repeals, and remakes with minor changes, the Public Health (COVID-19) Spitting and Coughing) Order 2021.

COVID-19 Australian Hotspots and Travel Restrictions

  • Imposes quarantine and testing requirements for certain persons who are arriving or have arrived in the NT who have been to Victoria, or a Victorian public exposure site, among other things.

Aged Care Direction (No. 29)

  • Restricts access to certain residential aged care facilities, requires operators of such facilities to develop a Workforce Management Plan and keep contact information for visitors, and requires face masks to be worn in certain facilities.

Declared Hotspots Direction

  • Identifies COVID-19 hotspots including 79 Victorian LGAs and 10 Unincorporated Areas.

Disability Accommodation Services Direction (No. 18)

  • Restricts access to shared disability accommodation services and requires specified persons to wear PPE and face masks and to ensure physical distancing.

Hospital Visitors Direction (No. 20)

  • Manages access to hospitals.

Interstate Areas of Concern (Vulnerable Facilities) Direction (No. 2)

  • Identifies interstate areas of concern for the Aged Care Direction, Disability Accommodation Services Direction, and the Hospital Visitors Direction.

Places of Concern Direction (No. 3)

  • Requires persons who have been in a place of concern to quarantine, wear a fitted mask and provide information to an emergency officer as requested.

Planning (COVID-19 Vaccination Service) Amendment Regulation 2021

  • Supports the timely roll out of the COVID-19 vaccination program by streaming statutory planning processes for the establishment of health care services that provide COVID-19 vaccination services by or for the Commonwealth, state or public sector entity.

Approval of the Governor of Extension of a Major Emergency Declaration

  • Extends the Major Emergency declared on 22 March 2021 for a further 28 days commencing on 29 May 2021.

Emergency Management (Cross Border Travel - Associated Direction No 13) (COVID-19) Direction 2021

  • Applies border requirements to certain Victorian and overseas arrivals, and while it has been revoked, it still applies to people who arrived in SA between 6.17 pm on 25 May 2021 and 6:00 pm 26 May 2021.

Emergency Management (Cross Border Travel - Associated Direction No 14) (COVID-19) Direction

  • Applies border requirements to certain Victorian and overseas arrivals, and while it has been revoked, it still applies to people who arrived in SA between 6:00 pm on 26 May 2021 and 7:45 on 28 May 2021.

Emergency Management (Cross Border Travel - Associated Direction No 15) (COVID-19) Direction 2021

  • Applies border requirements to certain Victorian and overseas arrivals and operates as an appendix to the Emergency Management (Cross Border Travel - General) (COVID-19) Direction 2021.

Direction Under Section 16 - Airports and Aircrafts - No. 3

  • Requires face masks to be carried and worn in airports and on an aircraft.

Care Facilities Directions (No 30)

  • Restricts access to care facilities in order to limit the spread of COVID-19 within a particularly vulnerable population - came into force at 11.59 pm on 27 May 2021.

Hospital Visitors Directions (No 26)

  • Prohibits certain visits to hospitals in order to limit the spread of COVID-19 - came into force at 11.59 pm on 27 May 2021.

Restricted Activity Directions (Victoria) (No 17)

  • Restricts the operation of certain businesses and undertakings in the Restricted Areas in order to limit the spread of COVID-19 - came into force at 11.59 pm on 27 May 2021.

Stay at Home Directions (Victoria)

  • Requires residents of Victoria to limit their interaction with others by restricting when they may leave their residence, restricting gatherings and requiring face coverings to be worn indoors and outdoors - came into force at 11.59 pm on 27 May 2021.

Victorian Border Crossing Permit Directions (No 14)

  • Replaces the Victorian Border Crossing Permit Directions (No 13) and continues to provide a 'traffic light' border crossing scheme for persons seeking to enter Victoria - came into force at 11.59 pm on 27 May 2021.

Workplace (Additional Industry Obligations) Directions (No 25)

  • Establishes additional specific obligations on employers and workers in specific industries in relation to managing the risks associated with COVID-19 - came into force at 11.59 pm on 27 May 2021.

Workplace Directions (No 30)

  • Limits the number of Victorians attending Work Premises to assist in reducing the frequency and scale of COVID-19 outbreaks in Victorian workplaces and establishes more specific obligations on employers and workers - came into force at 11.59 pm on 27 May 2021.

Approval for Flight Crew Pursuant to the Victoria (May 2021) Outbreak Response Directions

  • Approves entry of certain flight crew members to WA as outlined in the Arrangement.

Approval for Travellers Under a Specified Arrangement Pursuant to the Victoria (May 2021) Outbreak Response Directions

  • Approves entry to WA for certain travellers as outlined in the Arrangement.

Authorisation by the State Emergency Coordinator - Border Officers

  • Authorises border officers to give directions as authorised officers under, pursuant to, or for the purpose of giving effect to the Victoria (May 2021) Outbreak Response Directions.

Authorisation to Give Approval Under Paragraphs 14(f) and (g) of the Victoria (May 2021 Outbreak) Outbreak Response Directions

  • Authorises any police officer appointed under Part I of the Police Act 1982 acting at, or above the rank of, Senior Sergeant to give approval of a person or category of person under paragraphs 14(f) and (f) of the Victoria (May 2021) Outbreak Response Directions.

Controlled Border for Western Australia Amendment Directions (No 24)

  • Amends the Controlled Border for Western Australia Directions to prevent the importation of COVID-19 into WA.

Extension of Declaration (No. 2) of Public Health State of Emergency

  • Extends the public health state of emergency which came into effect on 23 March 3030 for a further 14 days.

Extension of State of Emergency Declaration

  • Extends that state of emergency declaration made on 15 March 2020 for 14 days until 12 am on 4 June 2021, or until it is revoked.

Flight Crew Directions (No 6)

  • Sets out the requirements that apply to a domestic flight crew member and an international flight crew member immediately after they enter WA.

Local Government (COVID-19 Response) Amendment Order 2021

  • Amends the Local Government (COVID-19 Response) Order 2020 in relation to interest on money owing to local governments, and rates or service charges.

Presentation for Testing Directions (No 24)

  • Requires persons entering Western Australia to comply with certain testing requirements.

Quarantine Centre Workers (Secondary Employment) Directions

  • Sets out conditions applying to quarantine workers where they must ensure that during the relevant period, they undertake work as a quarantine centre worker only and they do not work at more than one quarantine centre.

Victoria (May 2021) Outbreak Response Directions

  • Restricts access of people who have been in Victoria to WA (except in certain circumstances) to help prevent the importation of COVID-19 into WA following the outbreak in Victoria.

Victorian (May 2021 Outbreak) Directions for Recently Arrived Drivers and Flight Crew

  • Imposes certain obligations on transport, freight and logistics drivers and domestic flight crew who entered WA between 16 May and 25 May 2021 and were in Victoria on or after 16 May 2021.

Victorian (May 2021 Outbreak) Release for Tier 3 Locations Direction

  • Releases certain persons from quarantine requirements if specified conditions have been met.

COVID-19 Public Health Response (Exemptions and Conditions for Quarantine-free Travel) Amendment Notice (No 2) 2021

  • Exempts a person who arrives in NZ on an aircraft undertaking quarantine-free travel flight from the requirement in the COVID-19 Public Health Response (Air Border) Order (No 2) 2020 for isolation or quarantine after arrival, subject to conditions including that they have not been in Victoria Australia at or after 7.59 pm on 25 May 2021.

Exemption of Persons from Clause 8(2A), (2B) and (3) to (4) of the COVID-19 Public Health Response (Air Border) Order (No 2) 2020

  • Exempts certain persons from Clause 8(2A), (2B) and (3) to (4) of the COVID-19 Public Health Response (Air Border) Order (No 2) 2020.
